By using Sweetmyo products or services, you agree to this Agreement. If you do not agree, do not use them. This Agreement applies to your access, download, installation, registration, login, and use of the Sweetmyo Hub1 Terminal, Sweetmyo Training Suit, the Sweetmyo App, and related services.
1. Acceptance & Scope
2. Definitions (aligned with IFU)
"Hub1 Terminal" means the Sweetmyo electrical stimulation hub.
"Training Suit" means Sweetmyo's electrode-embedded garment.
"Sweetmyo App" means our mobile application that controls training sessions via BLE.
"Services" means features available through the App and cloud, including control, data processing, and account functions.
"Training Data" means information generated during use (e.g., session time, program selection, intensity levels).
"Biometric Data" means physiological responses related to muscle activation and current acceptance patterns used to personalize training.
3. User Eligibility
Only adults (18+) may use Sweetmyo products and services. Before first use you must confirm that you do not fall within the Contraindications listed in Annex 1. If you are uncertain about eligibility, consult a physician prior to use.
4. Accounts & Security
You must provide accurate registration information and keep your credentials secure. You are responsible for all activity under your account. Notify us immediately of any unauthorized use or security issue.
5. Purchases, Subscriptions & Renewals
Prices and taxes are shown at checkout. Subscription services renew automatically unless cancelled at least 24 hours before renewal. You authorize Sweetmyo (and payment platforms) to charge the payment method on file for recurring fees. Refunds are provided only where required by law. Subscriptions purchased via Apple App Store or Google Play must be managed within those systems. We may change subscription pricing with at least 30 days' advance notice; continued use after the effective date constitutes acceptance. We may suspend or terminate subscriptions for misuse or material breach.
6. User Content & Third‑Party Services
If the App permits content uploads (e.g., notes or photos), you must have the rights to such content and it may not be unlawful, infringing, or abusive. We may remove content that violates this Agreement. Third‑party services (payments, maps, analytics) are subject to their own terms.
7. Intellectual Property
All intellectual property in the products and services—including software, algorithms, documentation, designs, trademarks and branding—is owned by Sweetmyo Inc. You may not copy, reverse engineer, or create derivative works except as permitted by law. Feedback you provide may be used by us without obligation to you.
8. Safety & Compliance Summary
Sweetmyo Hub1 is marketed as a consumer electronic wellness training device and does not claim medical use at this time. Sweetmyo is fully compliant today under applicable consumer electronics frameworks (e.g., FCC, CE, WEEE). See Annex 1 for safety guidance and Annex 3 for regulatory details.
9. Warranty Summary
Hardware warranty for the Hub1 Terminal is one (1) year from original purchase, consistent with the IFU. We provide lifetime maintenance; out‑of‑warranty service may incur costs. Full warranty terms appear in Annex 3.
10. Limitation of Liability
To the maximum extent permitted by law, Sweetmyo is not liable for indirect, incidental, special, or consequential damages. Our total liability for all claims is capped at the greater of amounts you paid to Sweetmyo in the prior 12 months or US$100. These limits do not apply to liability resulting from our gross negligence or willful misconduct, and your non‑waivable consumer rights remain unaffected.
11. Dispute Resolution; Class Waiver
This Agreement is governed by the laws of Delaware, USA. Disputes will be resolved by binding arbitration administered by the AAA. Class or representative actions are waived. You may opt out of arbitration by emailing support@sweetmyo.com within 30 days of creating your account.
12. Changes; Termination; Notices
We may update services or this Agreement to reflect operational or legal changes. Material changes will be communicated electronically. We may suspend or terminate accounts for breach or misuse. Notices may be delivered via App, email, SMS, or our website.

Annex 1: Contraindications & Safety
Purpose
This Annex consolidates Sweetmyo Hub1 safety information, contraindications, warnings, precautions, training guidance, and adverse reaction instructions.
Contraindications (Do NOT Use If)
Do not use Sweetmyo if you have a cardiac pacemaker or implantable cardioverter‑defibrillator (ICD), are pregnant or suspect pregnancy, have epilepsy or a history of seizures, have had recent surgery or have an active inguinal/abdominal hernia, have uncontrolled heart disease or other serious medical conditions as advised by a physician, are under the influence of alcohol or sedatives, or are simultaneously using other electronic medical equipment (e.g., active ECG monitors). This list may include, but is limited to, the foregoing conditions. If uncertain, consult a physician before use.
Warnings & Precautions (IFU‑Aligned)
- Do not use in high‑humidity environments (e.g., bathrooms) or while sleeping or driving.
- During training avoid direct contact with others and keep metal accessories away from electrodes to prevent electrical shock.
- Do not exceed 80 minutes per session. Start at the lowest intensity and increase gradually.
- Only adults 18+ should operate the system. Keep all components out of reach of children and animals.
- Follow IFU instructions for electrode placement, training frequency, and maintenance.
- Do not plug/unplug the unit with wet hands. Avoid use with other electronic devices to prevent interference.
Training Guidance
Sweetmyo sessions can be more intensive than conventional workouts. A 20‑minute EMS‑assisted session may correspond to significantly longer conventional training. Allow 48–72 hours between Hub1 sessions to reduce risk of overtraining.
Potential Risks & What To Do
Potential risks include skin irritation at electrode sites, transient muscle soreness, dizziness or headaches, and—in cases of misuse—exercise‑associated rhabdomyolysis. Stop use immediately and seek medical advice if adverse effects occur.
Eligibility Confirmation in App
Before first use the App will display Contraindications and require you to confirm you are not in a prohibited group. We may suspend services for accounts at risk.
Annex 2: Privacy & Biometric Data Policy
Scope
This Annex explains the collection and processing of Training Data and Biometric Data generated by the Hub1 Terminal, Training Suit, and Sweetmyo App.
Categories of Data
- Account & Device Data: account ID, device IDs, firmware/app versions.
- Training Data: session duration, program selection, stimulation levels, electrode contact and connectivity status.
- Biometric Data: physiological responses and muscle activation signals used to personalize training; categories may include, but are limited to, activation patterns and current acceptance indicators.
Purposes of Processing
Provide and secure core functionality; monitor safety and performance; enable AI‑driven personalization; support product improvement and research using de‑identified or aggregated data.
Legal Bases & Consent
Processing is based on your consent and our legitimate interests in providing secure, high‑quality services. Where required (e.g., GDPR special category data), we will obtain explicit consent.
Sharing & International Transfers
We share data with service providers (e.g., cloud hosting, analytics, customer support) under appropriate contractual safeguards. International transfers use mechanisms such as Standard Contractual Clauses or their successors, as applicable.
Security
Data is encrypted in transit and at rest; access is role‑based and logged; controls are reviewed periodically.
Retention & Deletion
We retain personal data only as long as necessary for the purposes described or as required by law. De‑identified data may be retained for product improvement and research. You may request deletion subject to legal and safety constraints.
Your Rights
You may request access, correction, restriction, portability, or deletion of your personal data, and may withdraw consent at any time by contacting support@sweetmyo.com.
Children
Sweetmyo is intended for adult users. We do not knowingly collect personal data from children.
Annex 3: Regulatory Compliance & Legal Terms
Current Compliance (Consumer Electronics)
Sweetmyo Hub1 is marketed as a consumer electronic wellness training device and is fully compliant today under applicable consumer electronics frameworks. Applicable conformity may include FCC Part 15, CE marking, WEEE for e‑waste, and relevant safety/EMC requirements. No medical claims are made at this time.
Future Regulatory Roadmap
Sweetmyo intends to pursue additional regulatory clearances and approvals that may include FDA Class II (USA), EU MDR/CE (EU), UKCA/MHRA (UK), and NMPA (China). When such approvals are obtained, additional obligations (e.g., labeling, vigilance, UDI where required, quality system elements) will apply and will be reflected in updated documentation. Our current compliance under consumer frameworks remains in force during this pursuit.
Subscriptions & Pricing
Subscriptions renew automatically unless cancelled at least 24 hours before renewal. Pricing may change with at least 30 days' advance notice; continued use after the effective date constitutes acceptance. No refunds are provided for termination due to breach or misuse.
Warranty & Service (IFU‑Aligned)
Hub1 Terminal warranty is one (1) year from original purchase; free repairs are provided within scope. Out‑of‑warranty service is available at cost. The warranty excludes damage from misuse, unauthorized repair, or failure to follow IFU instructions.
Export Controls & Sanctions
You represent that you are not subject to sanctions and will not export or re‑export Sweetmyo products in violation of applicable export control laws.
Governing Law; Arbitration; Class Waiver
Delaware law governs. Disputes are resolved by binding arbitration under AAA Rules. Class or representative actions are waived. You may opt out of arbitration within 30 days of account creation by emailing support@sweetmyo.com.
Survival
Intellectual Property, Subscriptions & Pricing, Warranty & Service, Export Controls, Limitation of Liability, and Dispute Resolution provisions survive termination.
